Dr Jim O’Donovan is special counsel in the Commercial Advice and Litigation Group.
Jim joined Lavan Legal in 2009. He was previously a Professor of Law at the University of Western Australia. He has practised in most states in commercial litigation and banking and finance.
Jim has appeared in the Supreme Courts of New South Wales and Western Australia and the Full Court of the Federal Court and the Supreme Court of South Australia in some of the leading cases on corporate insolvency such as Powell v Fryer (insolvent trading), Sengate v Southern Equity Corporation and Re Stockbridge Ltd (schemes of arrangement) and Sheahan v Western United Ltd (constructive trusts and mutual set-offs). He has advised many insolvency practitioners around Australia.
Jim is the author of Company Receivers and Administrators, Lender Liability, and Personal Property Securities Law in Australia, and the co-author of The Modern Contract of Guarantee.
He is on the editorial board of the Insolvency Law Journal and the Companies and Secretaries Law Journal and is a regular contributor at state and national IPA Conferences and Banking and Financial Services Law Association Conferences.
