Environmental matters

Environmental issues are of critical concern in all planning and land development projects. We offer specialist advice on all aspects of State and Federal environmental legislation and regulations such as advising on licensing and approvals under the Environmental Protection Act 1986 (WA), including Environmental Impact Assessments (EIA), works approvals and premises licences, advice on all aspects of the Contaminated Sites Act 2003 (WA), and we offer expertise in environmental incident management.

Our team can offer guidance and expertise in relation to climate change legislation, including advising on all aspects of the National Greenhouse and Energy Reporting Act 2007, and the proposed carbon trading legislation.

We offer in-depth advice on transrelocation and controlled actions associated with endangered species and advice on the Environmental Protection and Biodiversity Conservation Act 1999.

Property and environmental litigation

In the event of disputes, we offer expert litigators who have experience in conducting planning appeals, ministerial EIA and licensing appeals, appearing before the State Administrative Tribunal (SAT) and conducting judicial review proceedings in the Supreme and Federal Courts. Land compensation

We currently offer advice to, and act for, land owners and acquiring authorities in relation to claims for injurious affection associated with local and regional planning scheme reservations, as well as in respect to compulsory acquisition of land by government authorities.

Native Title

We provide advice on native title claims under the Native Title Act 1993 (Cth) and provide assistance and advice with gaining approvals under the Aboriginal Heritage Act 1972 (WA) as well as advice on ILUAs.
