In today’s rapidly changing society, management of staff is increasingly intricate and complex. Errors can be costly and disruptive for businesses or business units. Terms and conditions of employment are constantly being affected by legislation. Our team provides timely and practical advice on every aspect of human resource management and workplace relations. We understand the challenges faced by employers and the impact of workplace decisions in terms of efficiency and cost. We formulate practical and relevant solutions with representation at Fair Work Australia and the Courts where necessary.

We coordinate the development of workplace policies with employers and provide advice and assistance in respect of equal opportunity issues. This includes preparing responses to workplace and equal opportunity claims by employees and providing representation at conferences and hearings before the Courts, the State Administrative Tribunal and the Human Rights and Equal Opportunity Commissions.

We are experienced and proficient in dealing with occupational health and safety complaints, workers’ compensation and personal injuries, policy advice and risk reduction.

Workplace relations

Our team has a thorough and detailed working knowledge of both federal and state workplace legislation, honed by our many years of experience.

We assist our clients to assess the impact of legislation on the workplace and to restructure employment contracts and enterprise agreements accordingly. We work closely with clients to develop employment policies and legislative compliant practice and procedure manuals.

Management support

We provide expertise in negotiating and drafting employment contracts, restrictive covenants, confidentiality agreements, remuneration packages, settlements, return to work arrangements and termination of employment processes. We also assist by advising on issues such as performance reviews, bonuses and equity arrangements.

Dispute resolution

Should industrial disputes arise, we strive to resolve them through negotiation, mediation and conciliation. Our aim is to forestall such a situation through careful planning and implementation of realistic workplace arrangements beforehand. However, where litigation becomes necessary, we have substantial and thorough experience in representing our clients in all Federal and State jurisdictions.

We have acted in disputes regarding the interpretation of employment contracts with respect to the copyright of intellectual property.

We have acted on behalf of many employers in the public and private sector, preparing responses to complaints and claims and providing representation in relevant jurisdictions.

Superannuation and taxation

All tax related and superannuation issues are handled by Lavan Legal’s tax specialists. This includes fringe benefits tax, redundancy schemes, employee share schemes, settlement issues and PAYG withholding obligations.

Occupational health and safety is an area of increasing concern to employers because of the potential financial impact of any legal action.

Migration

Australia actively seeks to expand its skilled workforce with overseas migrants. We provide advice and representation in relation to all categories of visa requirements, including business and family permanent resident visas, sponsorships and temporary visas. We process citizenship applications and provide representation in the Migration Review Tribunal, Administrative Appeals Tribunal and the Courts in relation to migration issues (Reg Agent 93/61948).
